Abstract

The facts of the case are simple, a small business is robbed via entry through the front plate glass window.  A suspect is found a short distance from the crime scene with mud and glass on his shoes.  Evidence is immediately collected and tagged from the suspect as well as from the crime scene which consists of glass and soil.  All the steps in the investigation are done properly and the forms filled out accordingly including the chain of custody.  The evidence was immediately taken to the forensic scientists where specific tests were given on each sample to match the soil and glass from the suspects shoes with the soil and glass at the crime scene.  The answers provided by the forensic scientists indeed placed the suspect at the crime scene. 









Written Assignment #3: Glass & Soil Crime Scene
            The following case is a robbery scenario.  The robbery took place at a small store near a vacant lot at night.  The source of entry is through the stores front plate glass window which was broken into, not opened.  A suspect was located by the responding officers a quarter of a mile from the crime scene and is placed under arrest.  Upon examination, the suspects shoes are found to have glass particles embedded in mud on the bottoms.   As per this case, the following objectives will be met: a full description of the soil and glass evidence found, where it was found, how it's to be collected and packaged, what tests are to be done by the forensic scientists in their labs and what information could be provided by the testing to connect the suspect to the crime scene. 
            As the investigator, my first priority is taking the suspects shoes into evidence.  I would first get pictures of the suspect wearing the shoes then I would take the shoes off as carefully as possible on top of something to catch any debris that may fall off.  Once the shoes are off the suspect I would take photo's, tops, sides and bottoms (as many angles as necessary) and then wrap each shoe in paper and  package them in a plastic bag or box.  I wouldn't take any of the mud or glass off the shoes.  I would leave that for the forensic scientists.  I would ensure the evidence bag or box has the proper information to include the contents, the time, date and where the evidence was collected. 
            Next thing I would do is take notes of the evidence collected so far describing the mud, i.e. color, texture, thickness, and a description of the glass as well, color, thickness and size. Since this is a scenario I will do just that.  The mud is dark black like fresh top soil.  It is smeared on the sides of the shoe and clumped in the treads.  The texture looks flakey and is drying rapidly becoming brittle falling away from the shoes in areas.  The glass is very small slithers and if it weren't for the nature of the very small but deep tread on the suspects shoes with the combination of mud the glass more than likely wouldn't have clung so well.  The glass is opaque white and has no other indentifying marks. 
            At this point the suspect has been searched for any other evidence that can further link him to the crime.  Fingerprints have been taken as well as a DNA sample.  The suspect is currently being interrogated.  While all that is going on I'm at the crime scene collecting further evidence from the broken window and the soil surrounding the property, especially under the broken window.
            The ground on the outside of the stores front shattered window is very wet.  I see what looks to be freshly planted shrubs and flowers.  To the side of the building is a stack of mulch  and a coiled up water hose not in use.  Underneath the hose are several empty bags of topsoil.  It hasn't rained in several days so at this time the conclusion is the store owner recently laid topsoil when he planted new plants and thoroughly watered them earlier that evening at closing causing the mud.  All of this will be confirmed with the owner upon his arrival on the scene. 
            There are foot prints under the window in which casts have been made as well as some larger shards of glass.  The majority of the glass is in the inside of the store below the window and a few feet in from the force of the hit.  Five feet into the room is a rock the size of a medium orange that at this time looks to be the object that was used to break into the store. 
            Pictures, sketches and notes are taken of the outside and inside of the store before evidence is collected.  A sample of the mud outside the store as well as a bit on the window sill are collected and bagged separately in plastic bags since the mud is still  wet, otherwise I would put the samples in manila envelopes.  I would want to ensure my evidence containers or bags are fresh and have never been used, are leak proof and sealable, and that I "uphold the integrity of each item of evidence by using separate containers.", keep the evidence from direct sunlight and heat and that I handle the evidence as little as possible (Osterburg & Ward, 2004, p.124-125).
             The shards of glass found on the outside of the store are placed in a cardboard box due to their size.   Every single piece of glass is picked up for the forensic scientists.  A cardboard box is used for the glass on the inside of the store as well due to some of the bigger pieces.  The smaller pieces are picked up using forceps and placed in screw-cap glass vials for smaller pieces or a vacuum specifically for crime scene evidence removal (Saferstein ,2007,  p. 49).  Every last piece of glass is collected and each parcel of evidence is listed with its contents, where found, and when.  I would also ensure that each container of evidence is properly documented to adhere to the chain of custody standards for eventual court use. 
            Now that the evidence is contained properly and an evidence submission form is completed, it now makes its way to the forensic scientists either by me personally or someone on my team, or by mail shipment.  Once the forensic scientists have "custody" so to speak of the evidence they will begin testing the items.  The forensic scientist would first want to identify the evidence given to them.  In this case, I have identified the mud as more than likely being topsoil and the glass is easily identifiable but testing gives an absolute definite as to what exactly the substances are. 
            The majority of this case has to do with comparison.  the forensic scientists have in their custody evidence from the crime scene and evidence from the suspect that upon visual inspection looks very similar.  However, the evidence needs to be subjected to a comparison analysis which means "a suspect specimen and a standard/reference specimen" endure "the same tests and examinations for the ultimate purpose of determining whether they have a common origin" (Saferstein ,2007,  p. 72).
            I believe the glass would be considered to have individual characteristics sense it could be fit together like a jigsaw puzzle which narrows down the testing.  Forensic scientist would want to see what type of glass came from the crime scene and what type of glass came from he suspects shoes by "finding and measuring the properties that will associate one glass fragment with another while minimizing or eliminating the possible existence of other sources" (Saferstein, 2007, p. 110).
            In this case, the glass fragments from the suspects shoes are more than likely too small to be fitted back together so they will now need to do a chemical comparison of the glass by using a flotation method to compare the densities of the glass found at the crime scene and on the suspects shoes.  Another method to be used is the immersion method where the "glass particles are immersed in a liquid medium whose refractive index is objected until it equals that of the glass particles" (Saferstein, 2007, p.111).
            The  forensic scientists would then use heat known as the hot stage (Saferstein, 2007, p.112).  Once these tests have been completed, they can now compare the density and refraction index values for their frequency of occurrence and evaluate the probability of the fragments origin as indeed being that of the store front window.   The tests given also depends on the glass such as tempered and non-tempered, for example.  The distinction between these two can be made simply by slowly heating and then cooling the glass called annealing (Saferstein, 2007, p.115).
            The forensic scientist must also examine the glass to see in which direction the glass was  forcefully broken.  A glass broken by a projectile such as the rock found at the crime scene will produce a fracture pattern where cracks will radiate outward and encircle the hole.  The radiating lines are called radial fractures and the circular lines are called concentric fractures (Saferstein, 2007, p. 116).  This information can tell investigators if indeed it was the rock that busted the pane of glass from the outside. 
            As for the soil sample, a forensic scientist specifically trained in geology would be conducting these tests.   The book states that most soils can be differentiated and distinguished by their gross appearance (Saferstein, 2007, p. 120).  The forensic scientist can do a side-by-side visual comparison of the color and texture of the soil sample that was brought in as evidence.  With this comparison test they must wait until each sample is dry to get an accurate visual of the soil.  Putting the samples under the microscope will also reveal similarities in the samples that could provide a match between the two.  The microscope can reveal plant and animal material and artificial debris and higher amplification will "help characterize minerals and rocks present in earth materials" (Saferstein, 2007, P. 120).  Saferstein also points out that by carefully examining and comparing the minerals and rocks naturally present in soil, one take advantage of the large number of variations between soils and thus add to the evidential value of a positive comparison (p. 120).  Another test used in some laboratories is the density-gradient tube technique used to compare soil samples.  This tests consists of a glass tube filled from bottom to top with liquids of successively lighter densities and is used to determine the density distribution of soil (Saferstein, 2007, p. 121). 
            In conclusion, all the steps have now been taken from the beginning of the investigation to the conclusion of the forensic scientists testing and evaluation of the evidence.  Each of these tests run can tell the investigator if the glass and soil found on the suspects shoes does indeed match the glass and soil collected at the crime scene.  The investigation process, from the collection and properly tagging the evidence to having the proof provided by the forensic scientist to link the suspect to the scene is all in a day's work for the teams outside and inside the crime labs.  With their hard work the suspect was indeed linked to the crime scene.

Abstract
The following essay depicts four particular scenarios providing limited details of a fire either in a building or residential home.  The writer must decipher whether each scenario is caused by arson or by accidental or natural causes using limited information obtained from the learning materials provided.  This writer believes two out the four scenarios were caused by arson going off the information provided in the scenario.

            The following essay explains whether certain scenarios were caused by arson or by accidental means according to information gleaned from the learning materials of the week.  Arson, meaning the fire was set on purpose for reasons such as a malicious act, revenge, for monetary gain or to cover up another crime.  While an accidental fire can range from heat sources such as heating or cooking systems, electrical systems, smoking or human negligence to natural heat sources such as spontaneous combustion and lightening (Osterburg & Ward, 2004, pgs 4932-493).   This writer will give an explanation of each scenario listed below as to the cause of the fire.
            Scenario 1: Investigators at a residential fire find much of the roof destroyed and the floor    in the living room seriously damaged.  However, there is little fire damage to the floors and the walls of the rooms not adjacent to the living room.
            The scenario depicts that there is no evidence of "streamers", meaning there were no separate and unconnected fires to spread the fire from one room to another by the use of gasoline, paper or other burnable sources (Saferstein, 2007, p. 319).  However this doesn't necessarily mean arson wasn't involved.  Considering the scenario doesn't state weather the walls were damaged at all in the one burned room, there is no V-shaped pattern that would help with the location of the origin of the fire.
            This writer believes this is an accidental or natural caused fire, not arson.  The roof is completely burned indicating that could be the source of origin and the seriously damaged floor could be caused by burning debris from the ceiling and roof falling into the room.  Natural reasons for the roof catching fire would include lightening.  It is also well known that heat rises.  If oily rags were stored in a poorly ventilated container in the attic (if this house has one) then the possibility, small as it may be, for spontaneous combustion has to be considered (Saferstein, 2007, p 317).  Other causes could include an electrical fire from a fixture on the ceiling of the room in question or an electrical issue in the attic, among other guesses. 
            Scenario 2: A large, multistory warehouse, bordered on the North and South sides by        residential areas, burns to the ground earlier in the evening.  Residents of both report seeing small fires burning on the ground floor earlier in the evening.
            There have been many cases where warehouses, especially abandoned ones, have burned down caused by the negligence of transients making small fires to keep warm.  However, due to the close proximity of residential areas it's doubtful transients are holding up in the warehouse, but this is no guarantee that that is indeed the case.  There is no evidence mentioned in the scenario that this particular warehouse is abandoned. 
            This writer believes this scenario is arson based.  Residents on both ends of the building saw several small fires which could indicate the use of streamers so the fire would spread throughout the warehouse or that there were more than one delinquent setting fires in different locations of the building.  Upon further investigation after the rubble is removed, irregularly shaped patterns on the ground would further indicate the use of accelerants on the floor adding to the arson conclusion.
            Scenario 3: The fire in the three-room office is extinguished before a great deal of             damage is done.  The floors of each room are charred, but there is little damage to the       ceiling. 
            This writer believes this is a case of arson mainly from the fact that the floor of each room was burned possibly due to streamer fires where a separate fire is set in each room spreading a "trail of gasoline or paper to cause the fire to move rapidly from one room to the next" (Saferstein, 2007, p319).  The fact that the ceiling in each room sustained little damage could also indicate a fast burning accelerant was used that burned off quickly.  Also the swift efforts of whomever extinguished the fire prevented the ceiling from suffering major damage. 
            Scenario 4: Most of the damage from a home fire is confined to two adjacent walls.              Neighbors on both sides report that the lights in the house went out shortly before the fire            started. 
            It is doubtful an arsonist would have lights on in the house as they went about their fire starting tasks.  However, if a homeowner were committing arson in their home for personal gain or to cover up a crime they probably wouldn't turn the lights off thinking keeping them on would take suspicion off of them.  And its normal to turn the lights off as you make your way out of the home.  However, this writer believes this was an accidental burning.  Considering the walls that were burned gives the indication that possibly a cigarette could be to blame or even an electrical fire involving a lamp sitting on a table in the corner of the adjacent walls. 
            To conclude, each fire related incident is a mystery until a full investigation  is conducted using the evidence found at the scene, witness statements, and an investigation into the owner(s) to rule them out as suspects.  Deciphering the above scenarios provides an insight into the world of arson or accidental fires giving the writer the opportunity to use judgment, imagination and information gleaned from learning materials to provide an assessment of the fire.

Crime Related to the Social Networking Site Twitter
            What's a twitter, you say?  Twitter, Facebook, any social networking site for that matter,  can get you in hot water without you even knowing it until it's too late.  Can you be held accountable, arrested, even found guilty of a crime for mere words you tweeted or a video you shared with your followers?  You better believe it!  Crime is on the rise in the social networking realm, ranging from "scams to online bullying" (Murphy, 2011).  The following essay will describe how information on Twitter is presented to the user, noting the areas that are public vs. private.  An article describing a crime conducted via Twitter will be provided explaining how the SNS was used to conduct the offense and the areas that were central to the investigation. 
            Twitter is used by many around the world to let their followers know what their status is at the whim of the individual twittering.  Twitter is a social networking site that connects individuals to what is happening now, the latest stories and trends, ideas, opinions and news by simply finding the account that is most interesting and following the conversation (About Twitter, 2012).  According to Twitter's guidelines for law enforcement page, most of an individual's twitter profile information is public, meaning anyone can see the profile photo, header photo, background image, an optional biography, and a person's status updates which are referred to as "tweets" (Guidlines for Law Enforcement, 2012). 
            Profile information that can be publicly viewed also includes an individual's name and user name, location, and cell phone number.  However, one can use the control your settings option to prevent ones location from being given publicly each time they put out a tweet and they can also select tweets to be private or protected which allows the tweets to be viewed by authorized followers only (About Public and Protected Tweets, 2012).  A Twitter user can give permission for Twitter to share their information to third parity web clients but Twitter does have the right to disclose personal information if they believe "that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address any fraud, security or technical issues; or to protect Twitter's rights or property" (Previous Twitter Privacy Policy Version 2, 2012).
            One particular story that made pretty big headlines concerning a crime committed via Twitter was about Dharun Ravi.  According to The New York Times, in September of 2010, Mr. Ravi, who used to attend Rutgers University, used a hidden webcam to capture his roommate kissing a man and then streamed the interaction between his roommate and the companion all over the internet, using his Twitter account to intimidate and embarrass his roommate (Dhaurn Ravi, 2012).  The young man who Mr. Ravi spied upon and set out to maliciously attack was Tyler Clementi, who later committed suicide by jumping from the George Washington Bridge on Sept 22, 2010, after learning his romantic interlude had gone viral due to Mr. Ravi's actions (Dhaurn Ravi, 2012). 
            What helped the investigation was Mr. Ravi's exact Twitter feeds that were publicly seen by all of his followers and, once up, could be altered by the original poster.  But, upon review of the records of the account, an investigator can see the original posts and use them in the case.  Which is exactly what the detective on the case did.  Detective Charydczak discovered that the deceased, Mr. Clementi, one day before his death,  had captured and saved a screenshot of one of Mr. Ravi's twitter posts  that read "Roommate asked for the room until midnight.  I went into Molly's room and turned on my webcam.  I saw him making out with a dude.  Yay." (Dhaurn Ravi, 2012).
            There were several Twitter feeds that Mr. Ravi posted in regards to Mr. Clementi's relationship that evening that were the sole reason why Mr. Ravi had charges filed against him.  It is clear to see that he led to Mr. Clementi's unstable mental health, driving the young man over the edge literally, but he wasn't charged with Mr. Clementi's death.  On March 16 of 2012, Mr. Ravi was convicted in New Jersey Superior Court in Middlesex County of bias intimidation of a hate crime and for "tampering with evidence and witnesses for tying to change Twitter and text messages in which he encouraged others to watch the webcam" (Dhaurn Ravi, 2012).  Even though Mr. Ravi faced up to 10 years of jail time, he was only sentenced to 30 days in jail, which he only served 20 days, three years' probation, 300 hours of community service, much need cyber bullying and alternate lifestyles counseling and a probation fee of $10,000 (Dhaurn Ravi, 2012). 
            To conclude, the case mentioned above is just one of many that represent the struggles that gays, lesbians and bisexual young adults, combined with cyber bullying, face around every corner.   As these cases continue, cyber bullying laws will get stricter in hopes of protecting the innocent victims.  Many still don't realize that, with a simple click, they could be committing a crime or they feel they are safe behind their computer.  These people need to wise up because they will get caught.  In most cases, and it is a real shame, they are caught after a person commits suicide. We can only hope that, with more awareness concerning this issue, individuals will stop using social networking sites to dole out their hate, jealousy, and even fears onto their victims.  It is a very public world out there and what you type may come back to haunt you.
